SPONSOR:

This Contest is being sponsored and administered by Icebreaker, a division of VF Outdoor, LLC. Any questions, comments or complaints regarding this Contest should be directed to Icebreaker, a division of VF Outdoor, LLC.

SYNOPSIS:

Answer a question to go in the draw for one (1) prize pack; the price pack includes one (1) icebreaker $500 gift card, valued at $500 USD.

ENTRY PERIOD:

The Contest begins on 00:01 am Pacific Time (“PT”) 23rd August 2021 and ends on 12:59 PT 20th September 2021 (“Promotion Period”). Sponsor’s computer is the official clock for this Contest.

WHO MAY ENTER:

The sweepstake is open only to legal residents of the United States. Entrants must be at least eighteen (18) years of age or older at the time. Any individuals (including but not limited to employees, consultants, independent contractors, and interns) who have, within the past six months, performed services for Sponsor, its licensees, and/or their respective parent, subsidiary, affiliated and successor companies and “immediate family members” and “household members” of such individuals, are not eligible to enter the Contest or win a prize. “Immediate family members” shall mean parents, step-parents, children, step-children, siblings, step-siblings, or spouses, regardless of where they live. "Household members" shall mean people who share the same residence at least three months a year, whether related or not. Potential winners may be required to provide proof of legal residency in one of the countries listed above upon request prior to prize award. Sponsor reserves the right, at any time, to verify eligibility requirements, in any manner it deems appropriate.

HOW TO ENTER:

An individual can enter the Contest by answering the multi choice question on the Facebook post promoted by icebreaker during the “Promotion Period”. The question is: “What is the benefits of wearing merino?”. A correctly submitted response to the question alongside submitting an email address is considered an “Entry”. Sponsor reserves the right to verify all Entries. If a dispute arises regarding the identity of an entrant, the authorized subscriber of the email account used at the time of entry will be considered the entrant. "Authorized account subscriber" is defined as the natural person who is assigned an email address by an Internet access provider, online service provider or other organization which is responsible for assigning email addresses or the domain associated with the submitted email address. Any mechanical reproductions or automated entries are prohibited, and any use of such automated devices will cause disqualification. By entering this Contest you consent to Sponsor, its promotional agencies and Contest judges storing and using the personal information you submitted with your entry for contest and advertising purposes.

WINNER SELECITON:

After the Entry Period ends, one winner will be selected at random among eligible entries received. Drawing will be conducted by Icebreaker, a division of VF Outdoor, LLC following the conclusion of the Entry Period. If the potential winner cannot be reached within two (2) days of attempted notification, the prize will be forfeited and Icebreaker, a division of VF Outdoor Canada Co shall select an alternate winner. If a potential winner does not confirm his/her address within two (2) days of initial contact, Icebreaker, a division of VF Outdoor, LLC may award the prize to an alternate winner.
Odds of winning will depend upon the number of eligible entries received.

WINNER NOTIFICATION AND AWARD OF PRIZE:

The winner will be notified by email within one week after the sweepstake has finished. The prize will only be awarded by Icebreaker, a division of VF Outdoor, LLC upon verification of potential winner and final approval by Icebreaker, a division of VF Outdoor, LLC. The potential winner will receive notification that they have won and will have forty eight (48) hours from receipt of winning notification to confirm that the notification has been received and to provide contact details as requested by Icebreaker, a division of VF Outdoor, LLC. If a potential winner of a prize cannot be contacted; is ineligible; fails to claim the prize; if the prize notification is returned undeliverable; or if a potential winner otherwise fails to fully comply with these official rules, he/she will forfeit that prize and the prize may be awarded to an alternate potential winner.

PRIZES AND APPROXIMATE RETAIL VALUE:

One (1) prize pack; each pack includes one (1) icebreaker $500 gift card, valued at $500 CAD. The total value of prizes awarded is $500 USD.

LIMITATION OF LIABILITY:

By entering this Contest or accepting a prize, all entrants agree to release, discharge, and hold harmless Icebreaker, a division of VF Outdoor, LLC, Instagram and Facebook, its parent and affiliates, employees, officers, directors, agents and representatives from any and all liability, claims, losses and damages arising out of their participation in this Contest or any Contest -related activities and the acceptance and use, misuse, or possession of any prize awarded hereunder, including, without limitation, all liability for injuries, including, but not limited to, personal injury, bodily injury (including, without limitation, wrongful death or disability), property damage, or loss or damage of any other kind arising in whole or in part, directly or indirectly, from delivery/non-delivery, acceptance, use or misuse of the prize or from participation in this Contest or any Contest -related activity.

INTERNET:

Icebreaker, a division of VF Outdoor, LLC is not responsible for electronic transmission errors resulting in omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alternation of entry materials, or for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions or limitations of any kind, or inaccurate transmissions of or failure to receive entry information by Icebreaker, a division of VF Outdoor, LLC on account of technical problems or traffic congestion on the Internet or at any Web site or any combination thereof. If, for any reason, the Internet portion of the programs is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Contest Icebreaker, a division of VF Outdoor Canada Co reserves the right in its sole discretion to cancel, terminate, modify or suspend the Contest. Icebreaker, a division of VF Outdoor, LLC reserves the right to disqualify any individual who tampers with the entry process. Caution: Any attempt by an entrant to deliberately damage any Web site or undermine the legitimate operation of the Contest is a violation of criminal and civil laws and should such an attempt be made, Icebreaker, a division of VF Outdoor, LLC reserves the right to seek damages from any such person to the fullest extent of the law.

CONDITIONS OF PARTICIPATION:

This Contest is void where prohibited. No transfer, assignment or substitution of a prize, except Icebreaker, a division of VF Outdoor, LLC reserves the right to substitute the prize (or a portion thereof) for an item of equal or greater value in the event a prize (or portion thereof) is unavailable. All federal, state, local and provincial laws and regulations apply. Entrants agree to be bound by the terms of these Official Rules and by the decisions of Icebreaker, a division of VF Outdoor, LLC which are final and binding on all matters pertaining to this Contest. Acceptance of the prize constitutes permission for Icebreaker, a division of VF Outdoor, LLC and its affiliates and agencies to use, anywhere in the world, winner’s name, photo and /or likeness, voice and biographical information, for any use, including, without limitation, advertising and promotional purposes without additional compensation, unless prohibited by law. If any provision(s) of these Official Rules are held to be invalid or unenforceable, all remaining provisions hereof will remain in full force and effect.

CHOICE OF LAW AND JURISDICTION:

Except where prohibited, all issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, or the rights and obligations of entrants, winners and Icebreaker shall be governed by, and construed in accordance with, the laws of the State of Colorado, without giving effect to any choice of law or conflict of law rules or provisions (whether of the State of Colorado or any other jurisdiction), which might otherwise cause the application of the laws of any jurisdiction other than the State of Colorado). Any action seeking legal or equitable relief arising out of or relating to the Contest or these Official Rules shall be brought only in the courts of the State of Colorado.
